The Arrested Lawyers made submission to the United Nations on ongoing crackdown against lawyers in Turkey

The Arrested Lawyers Initiative made submission to the UN Human Rights Council’s Universal Periodic Review for Turkey, The submission titled ‘Incarceration of Turkish Lawyers (2016-2019) | Unjust Arrests and Convictions’ covers

  • mass arbitrary prosecution of lawyers, 
  • violation of Turkish lawyers’ the freedom of association,
  • unlawful intervention to independence of Turkish Bar Associations,
  • unlawful restrictions on admission to the profession of lawyer,
  • Turkish Government’s abuse of Anti-Terror Laws,
  • misinterpretation of in flagrante delicto.

The submission concludes that Turkish Government’s ongoing crackdown against lawyers breaches

  • Arts. 58-61 of the Code of Lawyers which aims to ensure their independence and to provide a protection and guarantee for lawyers against acts of judicialharassment,
  • the right to liberty and security and the freedom of association of lawyers,
  • Paras 16, 18, 20, 21, 22, 23, 24, 27 of the UN Basic Principles on the Role ofLawyers,
  • Art 36 of the Constitution and Art 14 ICCPR,
  • Art 135 of the Constitution and Para 24 of the UN Basic Principles on the Role of Lawyers.

The submission further concludes Turkish Government’s ongoing unlawful praxis 

  • abolishes safeguards against torture,
  • constitutes illegal obstacle the right to access to justice and the right to legal counsel.
