The Turkish Constitutional Court rejected 90 percent of the 266,466 individual applications made in the last 8 years. Only in 8,659 of these applications (amounting to 4 percent) the Court found at least one violation.
The Constitutional Court published its statistics on the individual applications between 2012, when the individual application to the Court was introduced in the Turkish legal system, and March 31, 2020. According to the statistics, the Constitutional Court received 266,466 individual applications in this 8-year period. 220,985 of these applications were concluded while 45,481 applications are pending before the court.
Right to fair trial is the most breached right, constituting more than half of all violations the statistics showed. It is followed by right to property with a 30,5 percent share.
The statistics further showed that the individual application to the Constitutional Court increased exponentially over years starting 342 in 2012 and reaching 266,466 in 8 years.
The Turkish Constitutional Court examines the constitutionality, in respect of both form and substance, of laws, presidential decrees and the Rules of Procedure of the Turkish Parliament.
Starting with September 23, 2012 the Constitutional Court was authorised to review individual applications with respect to the fundamental rights and freedoms within the scope of the European Convention on Human Rights after the exhaustion of ordinary legal remedies. The purpose of the individual application was to reduce the number of applications made to the European Court of Human Rights.
In that capacity the Constitutional Court acts as a national European Court of Human Rights (ECtHR) and is recognised as a legal domestic remedy by the ECtHR to be exhausted.
