The Turkish Parliament has received 10 summaries of proceedings drafted by prosecutors for eight deputies, including main opposition Republican People’s Party (CHP) lawmaker Enis Berberoğlu, Turkish media reports said on Wednesday.
With the summaries of proceedings the prosecutors are asking parliament to remove the immunity of the deputies named, including Berberoğlu, pro-Kurdish Peoples’ Democratic Party (HDP) MPs Fatma Kurtulan, İmam Taşçıer, Murat Çepni and Feleknas Uca — who has three separate files — and the Democratic Regions Party’s (DBP)’s Salihe Aydeniz.
The remaining two lawmakers are ruling Justice and Development Party (AKP)’s Muğla deputy Mehmet Yavuz Demir and its ally, the Nationalist Movement Party’s (MHP) Hatay deputy Lütfi Kaşıkçı.
Berberoğlu, who was jailed on espionage charges and subsequently stripped of his parliamentary membership after his conviction, recently returned to parliament based on a Constitutional Court ruling, which is binding for all subordinate courts across Turkey’s legal landscape.
The court decided unanimously in January that Berberoğlu’s rights to stand for elections and engage in political activities had been violated by lower courts because legal proceedings against him should have been suspended due to his re-election as a member of parliament in the country’s June 2018 elections.
If parliament votes to strip the deputies of their immunity from prosecution, they will be tried by Turkish courts.
The prosecution of members of parliament has been possible since the CHP and the MHP lent support to a 2016 proposal submitted by the ruling AKP on removing deputies’ immunity from prosecution.
