Turkey to review definition of torture, perpetrators must face trial, UN says

The United Nations Committee Against Torture (UNCAT) has asked for clarification on the list of reported cases of torture and other human right violations from Ankara, ahead of its 5th upcoming review of Turkey.

One of the issues highlighted in the list is the definition of torture in the Turkish Penal Code (TCK). UNCAT requested that Article 94 of the Penal Code must be amended and that the definition of actions and coercion in order to obtain information or confessions from a person should be included in the penal code.

“Torturers should not go unpunished”

Another issue highlighted in the list of problems published by UNCAT is the impunity of perpetrators reported during the State of Emergency (OHAL) period.

UNCAT expressed its concern with Article 9 of the Decree Law No. 667, which says, “Persons who make decisions and perform duties under this Decree shall not be liable for their legal, administrative, financial or criminal liability.” This could give perpetrators the right to impunity. UNCAT requested more information on Turkey’s ongoing post-coup investigations.

UN Special Rapporteur on Torture and Other Cruel Treatment or Punishment, Nils Melzer released a statement in 2016 that stated, “The torture and other ill-treatment in the days and weeks following the coup attempt was widespread, particularly during police custody and other unofficial detention areas, where police, gendarmes or soldiers were tortured.”

UNCAT’s list of issues also included Turkey’s method of tortures, such as beating, kicking, punching, verbal assault, threats of sexual violence, long-term irritating positions retention, handcuffing, water, food, and sleep deprivation and rape, during the first period of detention.

UNCAT exposed the human rights violations of Turkey where detained people were forced to be informers under pseudonyms and based on these allegations, many people were arrested.

UNCAT also explained that prisons are overcrowded.  As other signatories, Turkey is expected to submit a report to the committee every four years. The fourth periodic report was submitted on 22 October 2014.
